Terms of Service

1. Acceptance

By creating an account or using Polsh AI, you agree to these Terms. If you do not agree, do not use the service.

2. Description of Service

Polsh AI is a web-based design tool that analyzes HTML, generates CSS overrides, and provides AI-powered design suggestions via the Groq API (Llama 4 Scout model). The service is provided "as is" and may change at any time.

3. Export Credits

Polsh AI uses a pay-per-export credit system. All design features (AI co-pilot, scoring, themes) are free to use within the workspace.

Credits: 1 credit is required to download or sync a polished design (HTML/CSS download or GitHub Push). Credits are purchased in packs and stack on your account. Credits do not expire as long as your account remains active.

4. Refund Policy

Due to the digital nature of export credits, all purchases are final. We do not offer refunds for credit packs once any single credit from that pack has been consumed. If you experience a technical failure during an export, please contact support for a credit reversal.

5. Acceptable Use

You agree not to:

• • Upload content that is illegal, harmful, abusive, or infringes third-party rights
• • Attempt to reverse engineer, scrape, or abuse the service
• • Use the service to generate or distribute malware, phishing pages, or deceptive content
• • Share your account credentials with others
• • Use automated tools to overload our infrastructure

6. Your Content

You own the HTML you import and the CSS you generate using Polsh AI. We claim no ownership over your content. By using the service, you grant us a limited license to process your content to provide the service (e.g., passing HTML context to the Groq API for AI suggestions).

7. AI-Generated Content

Design suggestions and CSS generated by the AI co-pilot are produced by Groq's Llama 4 Scout model. AI output may be inaccurate, incomplete, or unsuitable for your use case. You are responsible for reviewing and testing all AI-generated CSS before applying it to production websites. Polsh AI is not liable for design decisions made based on AI suggestions.

8. Third-Party Services

Polsh AI uses third-party services including Clerk (authentication), Supabase (database), Groq (AI processing), Stripe (payments), and Vercel (hosting). Your use of these services is also governed by their respective terms and privacy policies. We are not responsible for the actions or availability of these third parties.

9. Disclaimer of Warranties

Polsh AI is provided "as is" without warranties of any kind. We do not guarantee uninterrupted availability, error-free operation, or that AI suggestions will meet your specific needs.

10. Limitation of Liability

To the maximum extent permitted by law, Polsh AI and its operators shall not be liable for indirect, incidental, consequential, or punitive damages arising from your use of the service. Our total liability shall not exceed the amount you paid us in the 3 months preceding the claim.

11. Termination

We may suspend or terminate your account for violation of these Terms. You may delete your account at any time. Upon termination, your data will be retained for 30 days before deletion.

12. Governing Law

These Terms are governed by the laws of the jurisdiction where the operator is based. Disputes shall be resolved through binding arbitration or small claims court.
